Key Amendments to Rule 30

  1. 30(b)(1) added verbiage: If the deposition will be conducted by remote means, the notice shall provide the information and instructions necessary to appear and attend remotely.
  2. 30(h)(7)(B): Each person physically present in the room with the deponent during a remote deposition shall remain audible and visible for the duration of the deposition.

The following are suggestions to ensure a smooth process:

  • Camera Placement: Position the camera in a way that captures all individuals in the room. Consider using a wide-angle lens or an external camera that can be adjusted to include everyone present. Alternatively, each person in the room could have a laptop or camera connected to Zoom. It's crucial to ensure that only one microphone and speaker is active in the space to avoid feedback issues. For optimal audio quality, we recommend using a speakerphone or another dedicated audio system instead of relying on the built-in microphone and speakers of a laptop. Laptop audio may not adequately capture and project sound from across the room.
  • Microphone Setup: Ensure that the microphone is positioned centrally or consider using multiple microphones if the room is large. This setup helps maintain clear audio for those attending remotely.
  • Lighting Considerations: Good lighting is essential for visibility. Ensure the room is well-lit and that no one is backlit, as this can create shadows and make it difficult for remote participants to see faces clearly.
  • Test Equipment in Advance: Prior to the deposition, conduct a test run to check that all equipment is functioning properly. This step can help identify any potential issues before the actual session.
  • Inform Participants: Communicate with all participants ahead of time about the setup and what will be expected during the deposition. Clear instructions will help everyone feel more comfortable and prepared.
